1. About HexSplash

HexSplash is operated by Richard Thornton (trading as HexSplash) in Melbourne, Victoria, Australia. We provide:

• Discord Bot: Add our bot to your Discord server to generate beautiful colours using simple commands (!col, !grad, !pal)
• Colour API: A public REST API for generating colour images programmatically
• Dashboard: A web application to manage your server settings, credits, and bot configuration

Our service uses Claude AI (by Anthropic) to intelligently interpret your colour descriptions and create stunning hex codes, gradients, and palettes.

2. Who Can Use HexSplash

To use HexSplash, you must:

• Be at least 13 years old (matching Discord's age requirement)
• Have permission to add the bot to any Discord server you're configuring
• Comply with Discord's Terms of Service and Community Guidelines
• Agree to these Terms of Service

If you're adding the bot to a Discord server, you confirm that you have the authority to do so and accept responsibility for how the bot is used in that server.

3. Credits & Pricing

How Credits Work

• 1 credit = 1 bot command (!col, !grad, or !pal)
• Credits never expire once granted to your server
• All servers can see their credit balance in the dashboard

Free Monthly Credits

Every month on the 1st, servers with fewer than 100 credits automatically receive a free top-up to 100 credits. This means:

• Small servers can use HexSplash completely free
• You only need to purchase credits if you use more than 100 per month
• Free credits are our way of supporting the content creator community

Credit Packages

Need more credits? You can purchase them anytime through the dashboard:

• 500 credits — $10.00 AUD
• 1,000 credits — $15.00 AUD (most popular)
• 5,000 credits — $60.00 AUD
• 10,000 credits — $100.00 AUD

Gift Credits

You can also enable a gift link for your server, allowing your community members or supporters to purchase credits on your behalf. Gift credits work just like purchased credits and never expire.

4. Payment Terms

• All prices are in Australian Dollars (AUD)
• Payments are processed securely through Stripe or PayPal
• You'll receive your credits immediately after payment confirmation
• We keep transaction records for accounting and tax purposes (required by Australian law)

Refunds

Credits are non-refundable once purchased. However, this doesn't affect your rights under Australian Consumer Law. If our service has a major failure or doesn't do what we said it would, you may be entitled to a refund under the Australian Consumer Law.

5. Using the Service Responsibly

When using HexSplash, you agree not to:

• Use the bot to generate content that violates Discord's Terms of Service or Community Guidelines
• Spam commands or abuse the service in any way
• Attempt to circumvent rate limits or credit systems
• Use the service for any illegal purposes
• Share your dashboard account credentials with others
• Reverse engineer, decompile, or attempt to extract the source code of our services

You're responsible for how the bot is used in your Discord server. If members of your server misuse the bot, we may restrict or terminate access to your server.

6. Service Availability

We strive to keep HexSplash running smoothly, but we can't guarantee 100% uptime. Here's what you should know:

• The service is provided "as-is" without warranties of any kind
• We may perform maintenance that temporarily interrupts service
• We may modify features, adjust rate limits, or discontinue certain features with reasonable notice
• Third-party services (Discord, Anthropic, payment processors) may experience their own outages

We do our best to provide advance notice of scheduled maintenance, but emergency fixes may happen without warning.

7. Intellectual Property

Our Stuff

The HexSplash service, including the bot, API, dashboard, logo, and all associated technology, is owned by Richard Thornton trading as HexSplash. You can't copy, modify, distribute, or create derivative works without permission.

Your Stuff

• Your input prompts: You own the prompts and descriptions you provide to the bot
• Generated colours: You're free to use the hex codes, gradients, and palettes we generate for you in any way you like — commercially, personally, however you want
• No attribution required: While we appreciate credit, you're not required to mention HexSplash when using generated colours

8. Liability & Disclaimers

We're a small operation, and we want to be upfront about limitations:

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantees or rights you have under Australian Consumer Law (ACL). If our service has a major failure, you're entitled to remedies under the ACL.

Limitation of Liability

To the fullest extent permitted by Australian law:

• We're not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months before the issue occurred
• We're not responsible for issues caused by Discord, Anthropic, payment processors, or other third-party services
• We're not liable for any content generated by the AI or how you choose to use it

We don't warrant that:

• The service will be uninterrupted, secure, or error-free
• Generated colours will always meet your expectations
• The service will be compatible with all Discord server configurations

9. Privacy & Your Data

We care about your privacy. Our Privacy Policy explains:

• What data we collect (Discord user info, server details, usage logs)
• How we use it (to provide the service, process commands, manage credits)
• Who we share it with (Discord, Anthropic for AI processing, payment processors)
• Your rights under Australian Privacy Principles (access, correction, deletion)

By using HexSplash, you agree to our Privacy Policy.

10. Termination

You Can Leave Anytime

You can stop using HexSplash at any time by:

• Removing the bot from your Discord server
• Deleting your dashboard account
• Contacting us to request account deletion

When you remove the bot:

• Your server data is kept for 30 days (in case you want to re-add the bot)
• Your credits are preserved indefinitely — they'll be waiting if you come back
• After 30 days, most personal data is deleted (except transaction records required for tax compliance)

We Can Terminate Too

We reserve the right to suspend or terminate access if:

• You violate these Terms of Service
• You abuse the service or engage in fraudulent activity
• We're required to do so by law
• We decide to discontinue the service (with reasonable notice)

If we terminate your access for violations, you won't receive a refund for unused credits.

11. Changes to These Terms

We may update these Terms of Service from time to time. When we do:

• We'll post the updated terms at hexsplash.com/terms
• We'll display a notice banner on the website for 30 days
• The "Last Updated" date at the top will change
• Material changes will be clearly highlighted

Continuing to use HexSplash after the updated terms are posted means you accept the changes. If you don't agree with the updates, please stop using the service.

12. Governing Law & Disputes

These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

We prefer to resolve issues amicably — if you have a complaint or dispute, please contact us at richard@hexsplash.com first. We'll do our best to work it out.

13. General Legal Stuff

Severability

If any part of these Terms is found to be unenforceable, the rest still applies.

No Waiver

If we don't enforce a part of these Terms in one instance, it doesn't mean we waive the right to enforce it later.

Assignment

You can't transfer your rights under these Terms to someone else. We can transfer our rights and obligations to another entity (for example, if HexSplash is sold).

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HexSplash regarding the service.
